issues with virtualmin and creating a new virtual server

When I create a new virtual server and enable apache I get the error

Performing other Apache configuration .. .. configuration failed : Failed to copy /etc/php5/cgi/php.ini to /home/test22/etc/php5/php.ini : at ../ line 1376.

I believe this has to do with user / group rights. Creating a new virtual server is suppose to create a user test22 along with a group, and add www-data to this new group. But looking at webmin this user / group doesn exist. I tried to create in terminal and it says user already exist, same with group. I tried to delete the user / group and start over but trying to del the group results in test22 is member of group. Trying to delete the user results in error, something like cannot delete user in /etc/passwd. So at this point Im pretty lost on what to do, I don't want to blow away my server so looking for some assistance on solving this.
